Welcome to Makejani Rentals Connect. These Terms and Conditions govern your use of our website and services. By accessing or using our platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access our services.

2. Definitions

Throughout these Terms, the following definitions apply:

• "Platform" refers to the Makejani Rentals Connect website and all related services.
• "User" refers to any individual who accesses or uses our Platform.
• "Landlord" refers to Users who list properties for rent on our Platform.
• "Tenant" refers to Users who seek to rent properties listed on our Platform.
• "Property" refers to any real estate listed for rent on our Platform.
• "Rental Agreement" refers to any agreement between a Landlord and Tenant regarding a Property.

3. Account Registration

To use certain features of our Platform, you must register for an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.1 User Types

Users may register as either Landlords or Tenants. Different features and responsibilities apply to each user type.

3.2 Account Verification

We may require additional verification steps to confirm your identity, particularly for Landlords. This may include providing identification documents, business registration certificates, or other documentation.

4. Landlord Obligations

If you register as a Landlord, you agree to:

• Provide accurate and complete information about your Properties.
• Ensure you have the legal right to list the Properties for rent.
• Respond to rental inquiries and applications in a timely manner.
• Comply with all applicable laws and regulations regarding property rentals.
• Maintain your Properties in a safe and habitable condition.
• Honor any commitments made to Tenants through our Platform.
• Pay all applicable fees and subscription charges for using our services.

5. Tenant Obligations

If you register as a Tenant, you agree to:

• Provide accurate information in your rental applications.
• Use the Platform only to find legitimate rental accommodations.
• Respect the terms of any Rental Agreement you enter into.
• Communicate honestly with Landlords regarding your rental needs and intentions.
• Pay all agreed-upon rent and deposits as specified in your Rental Agreement.

6. Property Listings

All Property listings must be accurate and comply with applicable laws. We reserve the right to remove any listing that violates our policies or applicable laws. We do not guarantee the accuracy or availability of any Property listed on our Platform.

7. Rental Agreements

Our Platform facilitates connections between Landlords and Tenants but is not a party to any Rental Agreement. Any agreement between a Landlord and Tenant is solely between those parties. We are not responsible for enforcing such agreements or resolving disputes between Landlords and Tenants.

8. Payments and Fees

8.1 Subscription Plans

Landlords may be required to subscribe to a paid plan to access certain features. Subscription fees are non-refundable except as required by law.

8.2 Payment Processing

Our Platform may facilitate payments between Tenants and Landlords. We are not responsible for any payment disputes between Users.

8.3 Taxes

Users are responsible for paying all applicable taxes related to their use of our Platform and any rental transactions.

9. Prohibited Activities

You agree not to engage in any of the following activities:

• Violating any applicable laws or regulations.
• Posting false, misleading, or fraudulent content.
• Impersonating another person or entity.
• Harassing, threatening, or intimidating other Users.
• Attempting to gain unauthorized access to our systems or other Users' accounts.
• Using our Platform for any illegal or unauthorized purpose.
• Interfering with the proper functioning of our Platform.

10. Intellectual Property

All content on our Platform, including but not limited to text, graphics, logos, and software, is our property or the property of our licensors and is protected by copyright and other intellectual property laws.

11. Privacy

Your use of our Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our Platform.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including attorney's fees) arising from your use of our Platform or your violation of these Terms.

14. Termination

We may terminate or suspend your account and access to our Platform at any time, without prior notice or liability, for any reason, including if you breach these Terms.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes. Your continued use of our Platform after such modifications constitutes your acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
